Best tips to avoid making a mistake with your case

When going up against the legal system, here are several things you should do and NOT do in order to get what you deserve:

    • Do not move your car until the police have arrived.
    • Take pictures of bruises or visible injuries to yourself, along with pictures of damage to the automobiles involved. If You have been given any casts, slings or other medical devices to use as a result of injuries, take pictures of yourself wearing and/or using those devices.
    • Do not tell the police or anyone else that you were not injured. Especially with soft tissue injuries, the adrenaline as a result of the accident will mask any initial symptoms. It often takes as much is three days for those symptoms to manifest themselves.
    • Begin keeping a journal. It’s very easy to forget the problems you’re injuries have caused you as time passes. A large part of your case and it’s value are associated with pain and suffering and loss of enjoyment of life. It’s important to document what you’re having trouble doing and any activities you are missing as a result of the accident.
    • If you don’t live alone, let your family members know what you were going through. They will be essential witnesses in the case.
    • If you feel that you cannot work, you must get a note from a doctor taking you off work or stating your restrictions. Ohio law requires that lost wages are the result of the accident and that a doctor has given you a note that you are restricted or cannot work in order for you to prove and collect those lost wages.
    • If you are receiving treatment or physical therapy, is extremely important not to miss those appointments. The Insurance company will use this against you.

DOG ATTACKS

A dog attack can be a very serious injury. In the state of Ohio, the owner of a dog is strictly liable for any injuries caused by that animal. The only exception to this rule is if the owner can prove that the dog was provoked or that the injured party was a trespasser.

One aspect of a dog bite injury to be considered is the scar that will result after the injury has healed. It’s important to understand that a plastic surgeon will not opine as to revision of the scar until at least a year has passed after the injury. Even if the scar can be revised, it usually cannot be completely erased, resulting in some element of permanency to the injury.

In conclusion, please note that it is very important not to rush settlement of this type of case until the severity and permanency of the residual scar can be determined.

Follow our tips to avoid making a mistake with your case

    • It’s very important to document the injury immediately.
    • Photographs need to be taken of the injury as well as the premises upon which the injury occurred.
    • We advise the client to continue taking photographs as the injury heals.
    • If the injury causes a client the inability to work or perform daily living tasks these should be documented and, if possible, witnessed by a family member or friend. They will be valuable witnesses at a trial on the matter.

SLIP AND FALL

Many people get injured in slip and fall incidents every year, but there are some important things you should now about the mechanics of a slip and fall injury.

Slip and fall injuries are premises liability cases. The owner of the premises owes a duty of care that the premises are safe under reasonable and ordinary circumstances.

Typically this happens in a business environment but can also occur at a private residence. The essence of the claim must be that the injured party could not have reasonably ascertained the dangerous condition of the premises and that the owner was aware of and should have taken steps to correct the problem.

While this appears simple on its face, there are many defenses available to the owner. One of the most common defenses is that the dangerous condition was open and obvious and in plain view or that the owner had no knowledge of the problem.

Follow our tips to avoid making a mistake with your case

    • Our office suggests that you make a report immediately following the incident and if possible, take pictures of the accident scene shown from your perspective.
    • Get names and phone numbers of any witnesses to the event.
    • If possible, try to get a statement in writing from a manager or supervisor as to why the dangerous condition was not corrected and any routine maintenance schedules.

Remember that a slip and fall on a natural accumulation of ice and snow is normally not the property owners responsibility. There are some exceptions to this rule if the property owner has attempted to clear the snow and ice and has done so improperly.

Please contact our office for assistance with these difficult cases. We can help you recover your losses.

TRUCK ACCIDENT

Trucking accidents can be devastating. Just the sheer size of the vehicle make them a hazard. You should be aware that all trucking companies must comply with the Federal motor carrier safety regulations.

What most people need to understand is that the driver of the vehicle imputes liability to the carrier. This could involve equipment violations and/or maintenance records and logs. These need to be inspected by your attorney in order to determine the nature and cause of the accident.

Avoid making a mistake with your case

    • The Trailer is considered a motor vehicle.
    • Your case may involve where the trailer was stored if any repairs were made negligently and what maintenance program was in place.
    • The repair shop can be a defendant if repairs were negligently made.
    • The trucking company may be liable because it negligently hired or retained a problem driver.
    • What type of training was the driver given and what guidelines were in place?

MOTORCYCLE INJURY

The thrill of riding a motorcycle often outweighs the added risk for many people, but accidents still happen – and they are often devastating. The rider is far more exposed in the unfortunate event of an accident, and the risk of severe injury is far more likely.

In the case of a distracted driver or someone who unfortunately just didn’t see you, you still have a right to be fairly compensated. A severe motorcycle accident can lead to high medical bills and time off work, leaving you exposed for a financial disaster if you don’t seek legal action. We’ll work to ensure that you receive all of the help you can get.
